Calhoun County was created by an act of the Virginia General Assembly on March 5, 1856 from parts of Gilmer County. At that time, the county had less than 2,500 residents.
Calhoun County was named in honor of John Caldwell Calhoun (1782-1850), a famous statesman from South Carolina who championed the cause of slavery, the South, and state’s rights. Born on March 18, 1782, he graduated from Yale University in 1804, studied law, and was admitted to the bar in 1807. He was elected to the South Carolina state legislature (1808-1809), represented South Carolina in the U.S. House of Representatives (1811-1817); served as Secretary of War (1817-1825); Vice-President of the United States (1825-1832); represented South Carolina in the United States Senate (1832-1843); served as Secretary of State (1844-1845); and returned to the U.S. Senate in 1845 and remained there until his death on March 31, 1850.
The first meeting of the Calhoun County court house was held on April 14, 1856 at the home of Joseph W. Burson. His home was located at the mouth of Pine Creek, on the Little Kanawha River (Mr. Burson was later killed in the Battle of Arnoldsburg during the Civil War).
So you see we have a lot to live up to here in these modern times in order to honor these fine human beings.
The First Settlers of Calhoun County have left family names that are present even today!
The first native settlers in central West Virginia were the Mound Builders, also known as the Adena people. From what I understand of the subject, there were three different sects of mound builders. Remnants of the Mound Builder’s civilization have been found throughout West Virginia, with a high concentration of artifacts located at Moundsville, West Virginia, in Marshall County. The Grave Creek Indian Mound, located in the center of Moundsville, is one of West Virginia’s most famous historic landmarks. More than 2,000 years old, it stands 69 feet high and 295 feet in diameter.
According to missionary reports, several thousand Hurons occupied present-day West Virginia during the late 1500s and early 1600s. They were driven out of the state during the 1600s by members of the powerful Iroquois Confederacy (consisting of the Mohawk, Onondaga, Cayuga, Oneida and Seneca tribes, and joined later by the Tuscaroras tribe).
Many of our Calhoun County residents have Indian blood in them including Cherokee that were once were relocated to this area.
During the early 1700s, central West Virginia, including present-day Calhoun County, was used as a hunting ground by the Mingo, who lived in both the Tygart Valley and along the Ohio River in West Virginia’s northern panhandle region, the Delaware, who lived in present-day eastern Pennsylvania, New Jersey, and Delaware, but had several autonomous settlements as far south as present-day Braxton County, and by other members of the Iroquois Confederacy, especially the Seneca.
Over one hundred years later, during the civil war, there were Calhoun County Freedom Fighters, fighting for their rights and carrying through with damage and mayhem during behind the lines raids of Yankee camps. The hide and seek warfare carried on from small bands of Confederates cut deeply into the morale of union troops in the early 1860’s. Many of us in Calhoun County and surrounding area’s are direct descendants of some of those Calhoun Confederate hero’s.
The true grit and integrity of the early settler, along with American ingenuity and know how was what got many people through the civil war.

Many local people from the civil war era, that have descendants living just down the road a spell, had to do everything they knew- how- to- do- to- survive the war.
The Westfalls from Calhoun County converted most of their investments and cash to gold and silver, then buried it in bean pots on their property until after the civil war was over. That gold and silver brought a pretty penny when converted back to cash. The family lived high on the hog after the war and well into the early 1900’s.

So how could we have gone from a land of true hero’s and forefathers of freedom to a PRISON STATE in the 21st century?
The Central West Virginia Circuit Courts have been handing out long sentences and consecutive sentences, filling all of the jails to capacity… while defendants from circuit court wait for their day in court before being sentenced to prison.
Central WV Juries are programmed to believe that every defendant is automatically guilty as soon as they sit down in that hot seat!
The odds are stacked against you as soon as you walk in the courtroom. The jury system in WV is flawed at best.
Despite bullshit statistics that say West Virginia has a low crime rate… it is locking up more and more of our own!
In fact, the prisons are so over crowded, that many inmates sentenced to prison are doing their time in jail because there is no more room in prisons in WV!
According to an article published in the HUR HERALD….
” The West Virginia Supreme Court says the state Regional Jail Authority has the power to set per diem rates county’s have to pay for inmates.”
The jail bills have the potential to bankrupt WV counties!
Now because of a WVSC ruling, even Central WV counties are going to have to pay their jail bills and even pick up the tab for people arrested by city police!
But if you do the math we are screwed!
With all the heavy sentences being handed out even for misdemeanor offenses… the counties of Central WV will never be able to pay the jail bill!
And now the SUPREME COURT SAYS YOU GOTTA PAY!
The latest Supreme Court Opinion says…
“We take judicial notice of the fact that escalating regional jail costs have effectively crippled the counties of this state with regard to their respective budgetary decisions.”
Supreme Court Justice Larry Starcher issued a stinging concurring opinion in the case, writing the Regional Jail Authority is an example of an anti-Democratic trend in America!
“These “Authorities” can become laws unto themselves, orchestrating multi-million-dollar deals that benefit powerful political forces – but effectively outside the control of local and state elected officials, and ultimately, the voters,” wrote Starcher.
Starcher said the only “right” county commissions have is the “right” to pay up!”
SHOW ME THE MONEY!!
Current law now requires counties to pay per diem costs which can be as high as $49.00 per day.
WE the PEOPLE would like to know why so many people are in jail, or being sent to jail in West Virginia if we have such a low crime rate!
HELL…the Powers that Be have turned West Virginia into a mother fucking PRISON STATE!
Of course you need to also further realize that the powers that be have a vested interest in making WV a prison state. They are the ones organizing the plans to build more jails and prisons and make the prison industry the number one industry in WV!!
In reality, the number one industry in WV is growing WEED!
Further…that fact has made it necessary for “Secret Societies” of Guerrilla farmers to form. Also, certain factions involved are becoming more heavily armed and the Nor Cal boys have taught everyone the art of booby traps, making the woods unsafe for unsuspecting hunters and stupid trespassers, even the growers themselves!
Racial segregation is certainly present among the secret societies of growers, since it is predominately White’s that also have been infiltrated by more sophisticated “Secret Societies” that are certainly more of a violent breed than the late 60’s and early 70’s pot growers that used to have two or three big ones in the back yard.
You’re certainly not going to see any blacks out in the bush growing weed!
But, if you do want to see blacks all you need to do is travel down the road a piece to Glenville West Virginia where everyday is Martin Luther King day. Hell negro, rape yourself an underage white girl while you’re there! A GSC football player named DAVIS did and the 17 year old white girl was humiliated in the fact that she couldn’t even be referred to by her real name.
They certainly didn’t have a place for Davis at the jail!
No need to worry about paying the county bill there! He ain’t gonna cost us no $49.00 a day!

Flames swept through mobile home where
family escaped through dense smoke

The Sigman family escaped with the clothes on their back yesterday(Friday 30 Nov) afternoon when flames rapidly spread through their mobile home just off State Rt. 16 between Chloe and Nebo.
Monica Sigman said she and two of her small children were asleep in a bedroom when she was awakened by her husband Jerry.
“The place was filled with smoke, you could hardly see to get out,” she said, “Thankfully, we did.”
The dwelling was fully-engulfed when firemen arrived shortly after a 3 p.m. 911 call.
The family stood in the road watching firemen from the Upper West Fork and Arnoldsburg VFDs douse the flames.
“We have nothing, but somehow we’ll start over,” said Ms. Sigman.
Neither the mobile home nor the contents were covered by insurance.
The Sigmans have four children, a four-year-old son, three-year-old twin sons, and a one-year-old daughter.
Ms. Sigman acknowledged they have no clothing for the children or for she and her husband.
They are in need of virtually any household item or furniture.

Gilmer County Grand Jury indicts Jeremy Scott Dilgard of 5 Liberty Street Grantsville, for two counts of Grand Larceny and one count of breaking and entering.
Jeremy is (the stupid) one of two brothers who Grantsville State Police have recently used to obtain bogus search warrants. Also, as well as arrest warrants for Johnny Richards of Grantsville, who is also known as “The Lone Meth Ranger.”
Jeremy was arrested back in July of 2007 after police learned that he was selling stolen items to various individuals in the Grantsville area including the selling of Roofing Tin to Johnny Richards who was unaware the Roofing materials were stolen. Actually in most courts the term for that is valid purchaser, when the fact items were stolen is unknown.
Information has since surfaced that Grantsville State Police officers Jeff Hunt, and Doug Starcher pressured Jeremy (who is mentally handicapped) into implicating Richards in the actual theft of the Roofing Materials. This was done under promises of leniency!! The old’ Let’s make a deal if you squeal (like a pig) trick! (could that explain the blood Jeremy’s mom found in his shorts)
Jeremy claimed Richards was his accomplice(not)which resulted in Glenville magistrate Carol Wolfe issuing arrest warrants for Richards and setting an outrageous $150,000 CASH ONLY Bond for the alleged property crime.
The Grantsville State Police must have felt that the manipulation of Jeremy Dilgard went so well… that “once again” State Police Officers Hunt and Starcher used the name Dilgard to secure a search warrant for Johnny Richards’ apartment on November 1, 2007. This time police used Jeremy’s brother “Pete Dilgard” also known as “Bicycle Pete” to manipulate a Grantsville magistrate into issuing a search warrant for Richards’s apartment.
Information and evidence that has been circulating around the street, as well as the internet, regarding the police search of Richards’ apartment, was…that it was a planned setup, by “Richards” himself, to lure the unjust cops into his apartment! THEN… their unjust actions could be caught on hidden audio and video. The plan worked!
Trooper Doug Starcher led other officers into the setup! (which went much better than planned) Richards has issued a big “Thank You” to Dougie Starcher, and he has informed us here at CalPatty(via a third party) that West Virginia State Trooper Doug Starcher will be the first cop(to cop a feel from Beth)and to be questioned by Richards attorney’s at an upcoming preliminary hearing, thus we must hold off on providing other details(like sniffin panties) and/or other issues regarding the rogue actions of the rogue cops at this time.
“We the people” and the Calpatty Press would also like to inform Trooper Starcher that we are aware of the actual confidential informant (she often doesn’t wear underwear)“BETH” who Dougie and Deputy Matheney were getting what they thought was true information from.(Beth throws one mean TYRONE–wakes up… not at home–but at SS Harvest Party the week before raid!!) And let us just say you should have just used “Beth” as your source for a search warrant rather than forcing Pete Dilgard to sign the bogus statement you prepared.
Most of the editors of the “truth blogs” and the “Secret Seven” feel you should prepare another statement,first asking GOD for forgiveness, then your statement of resigning from your bent over position at the West Virginia State Police,or maybe we can get another CJ Ellyson-Campbell deal(oh oh-we can hear the cheer at the Calhoun Underground!) Face it Dougie, you are not going to have a special prosecutor like “Gerry(Mr Ethical Breach) Hough” to overlook your criminal conduct this time. NO CHESHIRE CAT SMILES! NO JC PENNY SUITS!

We are loved in the southern states, but California thinks we are an “Over the Top Experience” and we liked that!

LEGALIZE POT AND TAX IT? NO WAY, SAY LAWMAKERS
You can call it by a plethora of names — pot, herb, weed, boom or
even the popular 1960s-born slang term, “Mary Jane.”
Whatever moniker is applied to the leaves and flower of the hemp plant
Cannabis sativa — some 200 are available — there’s one thing you’re
not apt to call marijuana in West Virginia — legal.
Or a source of revenue.
Yet, new research conducted at the university level suggests West
Virginia is shelling out mega-bucks each year in a futile war to dry
up fields of marijuana, long considered the state’s biggest cash crop,
while missing out on a potential tax windfall.
“The use of criminal law to control the availability and use of
marijuana is a federal policy that is dependent on local law
enforcement for its implementation,” says Jon Gettman, a senior fellow
at George Mason University’s School of Public Policy.
Gettman is quoted in a report prepared by Ronald Fraser, a writer of
public policy issues for DKT Liberty Project, a Washington-based civil
liberties organization.
Fraser quotes another academic, Boston University economics professor
Jeffrey Miron, as saying the nation invests some $5 billion a year in
its enforcement of marijuana laws.
In this state, that shakes out to some $5 million for police, $12
million in the courts and another $2 million for offenders winding up
behind bars.
Miron feels the state not only could spare the $19 million price tag
in enforcement costs, but reap some $5 million in taxes a year by
regulating and taxing marijuana in the same fashion as other legal
drugs through the Federal Drug Administration.

Legislators in this region, however, are hardly eager to inhale that
idea.
“I feel that any kind of drug is wrong,” says Delegate Tom Louisos,
D-Fayette. “It’s a crutch for people to take the wrong direction. It’s
like alcohol.”
The idea of legalizing marijuana and taxing it is not a new one in
West Virginia. Actually, says Louisos, some lawmakers had discussed
this a couple of decades ago.
“We need people to be more responsible, not just take drugs like
that,” Louisos said.
“I’ve had people tell me it’s not that bad, just like beer, but I
never felt I needed to.”
Louisos said legalization would only create more societal woes, since
the state, once addicted to its revenue like gambling, would wind up
promoting it, and one result would be more highway tragedies.
“You’d just be creating another problem,” the Oak Hill businessman
said. “I’m absolutely opposed to it.”
Sen. Russ Weeks, R-Raleigh, views marijuana as “the gateway drug,” one
that ushers its users into the world of narcotics.
“It’s just like people getting started on beer and moving on to hard
liquor,” he said.
“West Virginia’s got enough problems with alcohol and prescription
pills. We certainly don’t need another addiction. We don’t need
another legal product out there that’s going to be abused and be a
detriment to society.”
Delegate Sally Susman, D-Raleigh, likewise is adamantly opposed to
making marijuana legal.
“It’s not supposed to be that horrible a drug, but people who do use
seem to graduate to tougher drugs,” she said. “Can you imagine seeing
tiny kids smoking that stuff?”
What’s more, Susman feels any tax revenue the state would derive from
regulating legal marijuana would be greatly offset by the social costs
of dealing with more drug addicts and the attendant health problems of
using stronger drugs.
“I wouldn’t be for that at all,” she said of proposed
decriminalization. “There are too many social issues involved.”

Gettman’s research was conducted for the National Organization for the
Reform of Marijuana Laws.
On that group’s Web site, a well-known advocate of decriminalization
is country singer Willie Nelson.
Marijuana busts doubled in the 1990s but failed to meet desired goals,
instead resulting in an increase in both usage and availability,
Gettman said he learned.
Pot arrests soared to 662,000 two years ago, contrasted with 260,000
in 1990.
Gettman also is quoted by Fraser as saying teenagers are arrested in
disproportionate numbers. Nearly 17 percent of those busted on simple
possession were 15 to 17, while 26 percent fell into the 18-to-20 category.
Fraser writes that the expenditure of millions in West Virginia’s own
war against marijuana is failing, at least by virtue of statistics.
For instance, the state notched 1,929 arrests in 2002, but the ranks
of users keep swelling. In 1999, he says, 3.6 percent of the
population were considered users, but in three years, the figure had
climbed to 4.9 percent. That compares to 4.9 percent in 1999 and 6.2
percent nationally.

Such arguments fail to sway legislators in southern West Virginia,
however.
One of them, Delegate Ray Canterbury, R-Greenbrier, questions the
legality of a state legalizing marijuana, pointing to a recent federal
court ruling striking down an attempt by California.
“And you’ve got to remember, most of what I’ve read, marijuana is
harder on the lungs than cigarettes,” he says.
“It has more carcinogens than cigarettes. What would be the public
cost of dealing with the health issues that would arise from it? That
would probably exceed the $5 million you’d get from taxes. Marijuana
has problems of its own.”
Delegate Ron Thompson, D-Raleigh, is “absolutely” opposed to making it
legal to own and smoke the weed.
“If you did something like that, you would be encouraging something
that’s obviously harmful to society and harmful to individuals, and
that kills people,” he said.
“I’m against it first and foremost. It’s just my stance on drugs
period and the use of drugs. And secondly, I don’t think the state is
in that bad a shape that it would have to rely on a tax based on that.”

I have been doing some research on police corruption in WV…for personal reasons…and came upon your site. I am very interested in speaking with you.
I am living out of state and attempting to research as much from here as possible. My family is in the middle of an unconscionable mess with local police. My family members there are very very honest and hardworking people that have NEVER been in ANY kind of trouble in their lives. For god sakes…they don’t even drink alcohol…which I would need to get me through every day living there! lol I am greatly concerned how things have turned…just how easy it is for things to go south in a very short amount of time. They have had their eyes opened to corruption…and I believe are still a bit naive to what can really happen to them because of it.
My hopes with speaking to you are not to help me fight my personal battle…only for some advice for accurate sources (public sources) that I may be missing and any other advice that you may have. Obviously, you know how difficult it is when more than likely…I can’t even trust their own attorney! I see him turning his head to so many illegal actions against my family…and my family says, “well…that’s just how it goes…it is who ya know here…who ya pay”. I cannot live with this statement.
I have committed myself to this…even lost my job…it seems…because of my time involved with this and concern for my family. I am not a religious person, per se, but I pray to God that I can find SOME organization…lobby my ass off…do whatever it takes to stop this lunacy that “this is just how it is in WV…everyone is corrupt”. I pray that our system of government…the foundations of our county…become a part of WV culture soon. I am willing, at this point, to do what it takes to help make that happen.
I am well aware of the danger that I would be in if I come there and “snoop around and stir up shit”….especially being a low life woman! I am well aware that I will probably be run off the road, arrested, slandered, harassed and followed. It happens to my family continuously. I don’t walk into this blindly.
I have a complex issue…at this time will only mention in passing some of my interest. My concentration is on Marion County…Judges Fox and Janes (?)…prosecutor Pat Wilson…Corporal Adam Scott….and other officers too numerous to mention…and finally the parole officers and DSS (not sure what you call it in WV…here it is the Department of Social Services). I am also interested in corruption in police department and turning heads to drug trafficking…
I hope to hear back from you. I found your article in reference to bad cops and public officials, dated June 13, 2007, very enlightening and open (raw). You have balls…I like that. I, on the other hand…for now, will have to remain a little less obvious to the cause…as I believe some major things will be uncovered.

Those lawmakers, the “authorities”, obviously do not have any clue. If I were them I would be ashamed for people to know just how clueless I was by making such ignorant statements publicly. This is no different than a surgeon who has no medical training, or a journalist for some fancy rag who can’t read or write. These “lawmakers” must have all gone to Calhoun School (like HT?)
Here are some FACTS. in Calhoun High School, approximately 85 to 90% of students have either tried pot or smoke it regularly. Roane County School, the same. When I was in school at LEAST that percentage smoked pot if not more. Which brings us to one conclusion. Either all these lawmakers are the ONLY ones who DIDN’T participate, or SOMEONE is lying and hypocrites. I even know a couple STATE COPS who have smoked pot. Horrors! But it’s true.
These “lawmakers” don’t sound any different than George Bush telling us how we NEEDED to go to war because Iraq had WMD. And HE’S never FOUGHT in any war himself… I can’t believe people are so ASLEEP that they can listen to this nonsense and not recognize it as nonsense.
Really, one would have to ask themselves, would a legalize situation really increase smoking or participating?
Also, that leads to stronger drugs thing was proved as false about 20 years ago, so they have not done their research. It is laughable.
If people want to do hard drugs, they do, and it has nothing to do with smoking hooch.
In addition, some people don’t choose to smoke marijuana whether it would be legal or not.
Is marijuana use a bigger problem in Amsterdam where you can get it down at the hash shop?
The advantages would be much greater than 5 million tax intake, they have to be kidding! There are individuals that are making a mill or two a year from their growing operations after every person got paid.
Most of those lawmakers aren’t even close to being in the loop. Given that, how could they make a educated decision.
The numbers of people that smoke the magic herb wouldn’t really change to any significant degree, given many of the above facts.
The advantages to legalization are far greater than filling up our jails and breaking the counties with bills they will now be forced to pay according to this article.
It’s very possible that making pot legal is a situation where the “powers that be” don’t want anyone cutting in on the profits from bringing in the big loads from Mexico. The availability in large amounts has never been greater. The Mexicans are getting rich rich rich and hundreds of millions of dollars are leaving the US. The dope dealers in Mexico biggest problem is where to stash all their American money.
If it was OK for every person to have 6 to 8 plants a year then we could keep all those outbound dollars at home and the state could sell G-13 which is the government seed that is darn good.
The kick back to people in charge of the big loads is a factor that will most likely never bring a legal situation.

Washington County officials will never again be able to just make accusations to the Governor of WV and have a citizen extradited to their state all because of Johnny s fight and efforts to prove West Virginia State Trooper Jeff Hunt lied along with Ohio officials in magistrate Postalwait s court room.
As it turned out when Johnny turned himself in to Ohio officials, court hearings proved the abduction charges were false and those criminal charges were dismissed. MORGANTOWN, W.Va. (AP) – West Virginia University’s student government president has resigned following a weekend drunken driving arrest.
David Kirkpatrick hand-delivered a note Tuesday(yesterday) to the Daily Athenaeum, the student newspaper. In the note, he said he didn’t want his defense against the charges to interfere with student government.
The 23-year-old Ft. Myers, Fla., resident was pulled over by a Morgantown police officer early Saturday morning.
According to a police report, Kirkpatrick refused to take several field sobriety tests or a chemical breathalyzer test. He was arrested and released on a $250 bond.
Steve Goodwin, chairman of WVU’s Board of Governors, said Kirkpatrick made a mature decision in resigning.

WVSP Corporal B.S. Snodgrass, lost control of his cruiser, ran off the road, and hit a stone embankment on the shoulder.
Snodgrass was not hurt in the accident, but his cruiser had to be towed away from the scene.
Snodgrass works out of the Parkersburg detachment in Wood County.

It was a good day Wednesday for auto body repair folks, with the annual crash and dent first snow day event, where it seems drivers are ill-prepared or have a memory lapse about driving on slick highways.

A former Charleston police officer was sentenced for double dipping.
Lt. Eric Eagle was placed on two years probation and fined $11-hundred.
Eagle pleaded guilty to working more than 100 hours at the Town Center while on duty as a Charleston officer.
He is the 4th Charleston police officer sentenced for double dipping.
James Sands and Lola Hart pleaded guilty, while James Nowling was convicted by a jury.
Many of us started Wednesday with a scraper and snow shovel and if that’s where your run in with the winter weather stopped, consider yourself lucky.
Some people didn’t have such a pretty first snow. Doing more than slowing people down, it landed many off the road and into a ditch.

Friday they are shipping 5,000 inmates out of California to east overcrowding, according to NBC11.
NBC11’s Mike Luery reported state prison hold more than 174,000 inmates. That’s the highest in state history.
Luery said the prisons are so over-crowded, male inmates are likely to run out of beds by June.
The first transfers could start within days, although administrative appeals by inmates could delay some for up to 10 weeks. Corrections Secretary James Tilton said the action is needed to relieve overcrowding that threatens the safety of guards and inmates in the nation’s largest state prison system.
“We are severely overcrowded, and the need for more space is absolutely critical,” Tilton said in a statement. “These transfers allow us to improve the safety of inmates and correctional officers while avoiding the potential of being unable to accept new inmates. This decision is being made to protect public safety.”
Private prisons in Mississippi, Arizona and Oklahoma are likely to receive the transferred inmates, Tilton said.
Lawsuits have left federal courts in charge of various aspects of California’s prisons, with overcrowding the root of many of the system’s problems.
In December, a federal judge warned that he would start releasing inmates early or prohibit convicts from being sent to state prisons from county jails unless the state acts immediately to solve the overcrowding.
That threat followed an executive order signed by Gov. Arnold Schwarzenegger in October authorizing voluntary and involuntary transfers of up to 5,000 inmates. At the time, a survey found that nearly 20,000 inmates were willing to be sent voluntarily to other states.
Since then, however, only about 380 inmates have volunteered, despite a marketing campaign by the Department of Corrections and Rehabilitation that includes showing inmates video tapes of the more favorable living conditions in out-of-state prisons.
In one videotape, a former California inmate boasts about having television selections that include ESPN.
California’s 33 state prisons are designed to hold 100,000 inmates but currently house about 174,000. About 16,000 inmates sleep in gymnasiums, hallways and other common areas that have been filled with beds.

RUSH SENTENCING POSTPONED TO JANUARY

The sentencing of Ronnie Rush for the murders of Calhoun residents Ward Groves, 69, and Mary Hicks, 60, has been postponed.
The sentencing was scheduled for today in Jackson County, but has been moved forward to January 25, 2008 at 10:30 a.m. in Ripley.
The delay is likely related to another pending appeal of the jury’s decision during a recent re-trial.
Defense attorney Teresa Monk, in a motion filed November 21st, is asking to set aside the most recent verdict and grant a new trial, saying that “Cpl. Doug Starcher had illegal contact with four male jurors,” during a lunch break outside the Jackson County courthouse.
Rush, 21, has now been tried twice and been found guilty twice for double homicide among other charges. He was first charged when he was 16 in 2003.
Rush was found guilty on two counts of first degree murder by a Calhoun jury in December, 2004 for the slayings, but the WV Supreme Court ordered a re-trial because the West Virginia State Police in Grantsville botched the case.
Monk says “It is simply a matter of following the law and getting Mr. Rush a fair trail.”
Also in the motion, Monk indicates there are other problems with the jury, writing “Counsel has reason to believe that other juror misconduct took place.”
Judge Thomas Evans III, after interviewing the four jurors, dismissed two because of conversations the men had with Cpl. Starcher regarding mutual acquaintances in the WV State Police, with the trial then continuing.

For several years, counties around the state have struggled to come up with enough money to pay the state Regional Jail and Correctional Facilities Authority for inmates.
The dispute reached the state Supreme Court of Appeals, which recently issued a writ of mandamus saying the Regional Jail Authority is right – counties have to pay up.
“Given this Court’s duty to uphold the laws of this state, which includes the enactments of our Legislature, we are … constrained to recognize the mandatory language directing that the counties ’shall pay’ for the costs of operating the regional jail facilities,” wrote Justice Joseph P. Albright in the majority’s opinion.
The state continues to lock-up more offenders, although the crime rate goes down. The WV County Commission Association says the issue is locking up people who are not dangerous and pose a risk.
“The regional jail is a cost that counties have little control over,” said Patti Hamilton, executive director of the West Virginia Association of Counties. “So we are approaching this by looking at the number of people locked up.”
Hamilton said, counties may have to levy a tax on citizens to help pay for the jails. She admitted the tax would not be popular, but counties may have no other option.
“Being hard on crime is politically popular, and we all want public safety, but paying for it is not a popular thing,” she said.
I would just like to say this site rocks! I love how you don’t hold anything back and you tell the whole story. Your not like the Tv news or newspapers which are only allowed to print or report what the Law (cops) say they can report. I asked the owner/editor of a local newspaper recently why does he print and only report slanderous one sided articles. His reply was that’s what the law tells him he has to report. They apparently write the story for him and he prints it. Of course, he isn’t going to question the law (cops) if he did that they might look into his families little activities they have going on the side. West Virginia is so fucked up it’s awful. You have corrupt politicians and law enforcement doing what ever the hell they please. If you get on their bad side or aren’t one of their informants, whores, or friends then your fucked.
I recommend to everyone that if you can afford it and the law happens to want to go after you for some reason to hire a lawyer out of Charleston. I know a couple of lawyers their who are a little expensive but are damn fine lawyers. I had the opportunity to watch them in just magistrate court. They fucking made the magistrate and the arresting officer in the case look like morons. The magistrate and arresting officer in that case had no evidence really to get a warrant but she issued one anyways. Then they found pills at the residence. The pills weren’t even narcotics yet the police said they were. So they took 4 people to jail that nite and she set their bond at $100,000 a piece thinking that she fucked them over that nobody had the money to get them out she was wrong. So, what I am trying to say is that you can be arrested on phony drummed up charges very easily here in the Great State of West Virginia.
So be careful of who you think your friends are, cause in the end we really have no friends. The law loves to play people against one another. I would also like to say that you guys who write this blog are very gifted and talented keep up the good work and I recommend this site to everyone I know. Oh, just a hint their are a lot more corrupt elected officials hen you guys apparently know of.
A hint I am referring to is that you need to pay certain to attention to the magistrates offices in Calhoun and Braxton County. I happen to know a lot of illegal stuff goes on in those offices because their above the Law and so are their families….

Yes, this is true and the SS determine who the individuals are that are responsible for making those types of bad things occur, and then are telling the truth about them. The number of crooked sons’ of bitches that pass themselves off as public officials is pathetically high!

You know the latest big whoop dee doo over the MORRIS CRIMINAL JUSTICE CENTER is a sign of the times and only endorses what the CalPatty Press and other truth blogs have been saying all along about Gilmer County being the HUB for the “power elite” that want nothing to do with improving the community for the common folk–they are only focused on making a profit for themselves and training more dupes to enslave the general population, so that they can better control the cash flow into their own pockets and at great detriment to the common person on the street. We will find more maximum one year sentences for first offense misdemeanors and more corrupt police and more rape and murder by the powers that be.

The state of West Virginia is so crooked that the high state officials will not take action against bad apples UNLESS IT IS THEIR IDEA! That much we have been told by experienced people in the know.
We have been schooled that-that will be the only way, since WV state officials don’t want to admit to the corruption that has been going on for years and years in WV
WV has a real bad reputation among law offices in other states for being the MOST CROOKED to the point where they have stated that it is very dangerous for us to expose the truth. We were warned that the powers that be may attempt to make a move on us, so that is why we document everything and keep good attorney’s on retainer. But, other out of state folk are talking about murder and they would not put it past the people we are exposing to at least make an attempt, and they also hit it on the head when they said they suspected that they have already tried to imprison SS members on false and made up felony charges, so they hit that one right on the money, especially after we gave them all the facts and figures. Now when highly educated members of high courts agree with little ole country folk like us, that are plain and ordinary folk, then that is really something!
